What Are Punitive Damages?

How are Compensatory and Punitive Damages Determined?

Additionally, the burden of proof that a plaintiff must satisfy in order to obtain punitive damages may be higher, with states often requiring evidence to be “clear and convincing” or meeting a similar stringent standard.

It is also important to understand the role of comparative negligence in seeking damages. Many states, like Nueva York, adhere to a comparative negligence system, meaning if the plaintiff is found to have contributed to their own injuries, their compensatory damages may be reduced proportionally.
